CHAPTER CONSTITUTION
WE THE MEMBERS OF THE U.S.S. JOAN OF ARC, NCC-73289, IN ORDER TO ESTABLISH A GROUP FOR ALL PERSONS WITH AN INTEREST IN STAR TREK SPECIFICALLY AND SCIENCE FICTION IN GENERAL AND TO PROMOTE THE IDEALS OF THE STAR TREK PHILOSOPHY THROUGH ACTIVITIES FOR OUR MEMBERSHIP AND SERVICE TO THE COMMUNITY , DO HEREBY ESTABLISH THIS CONSTITUTION.
ALL REFERENCES TO PEOPLE IN THIS DOCUMENT ARE MALE FOR SIMPLICITY OF LANGUAGE. THERE IS NO INTENTION TO EITHER SLIGHT NOR ACCENTUATE EITHER GENDER.
ARTICLE I PRIME DIRECTIVES
1.NAME AND AFFILIATION: THE NAME OF THIS CHAPTER WILL BE THE U.S.S. JOAN OF ARC AND WILL BE AFFILIATED FOR ITS ENTIRE EXISTENCE WITH STARFLEET: THE INTERNATIONAL STAR TREK FAN ASSOCIATION, AND WILL CONFORM TO ALL RULES AND REGULATIONS OF THE PARENT BODY. NEITHER THE CONSTITUTION NOR THE GENERAL ORDERS OF THE JOAN OF ARC SHALL CONFLICT WITH THE STARFLEET CONSTITUTION OR OTHER CONTENTS OF THE STARFLEET MEMBERSHIP HANDBOOK.
THE PRIME DIRECTIVE OF THE JOAN OF ARC IS TO PROVIDE A FUN AND FRIENDLY VENUE FOR ALL PERSONS INTERESTED IN STAR TREK AND OTHER SCIENCE FICTION TO GATHER IN ORDER TO BUILD FRIENDSHIPS THROUGH SHARED ACTIVITIES AND COMMUNITY SERVICE, THEREBY LAYING THE FOUNDATION FOR THE BRIGHT FUTURE AS SEEN IN STAR TREK, THE FICTIONAL CREATION OF GENE RODDENBERRY IN ITS MANY VARIED FORMS.
2.PURPOSE: TO THAT END, THE PURPOSE OF THIS CHAPTER IS TO:
A.ENCOURAGE ALL ENJOYABLE, LEGAL AND REASONABLE ACTIVITIES AND EFFORTS BY ITS MEMBERSHIP IN CONNECTION WITH STARFLEET AND THE STAR TREK PHILOSOPHY.
B.ESTABLISH AND MAINTAIN A FRIENDLY, FAMILY-LIKE ATMOSPHERE AMONG ITS MEMBERSHIP AND THOSE AFFILIATED WITH STARFLEET TO THE BEST EXTENT POSSIBLE.
C.HOLD OPEN MEETINGS IN PUBLICLY ACCESSABLE AREAS IN ORDER TO PROVIDE A PLACE WHERE THESE PEOPLE MAY MEET AND EXCHANGE IDEAS IN SAID SPIRIT.
D.MAKE AN EFFORT TO ATTEND OTHER STARFLEET AND REGIONAL FUNCTIONS AND TO SUPPORT THEM IN THEIR EFFORTS WHENEVER IT IS FEASIBLE AND REASONABLE TO DO SO.
E.PROVIDE A VARIETY OF ACTIVITIES, BOTH STARFLEET / STAR TREK RELATED AND "NON-TREK" FOR THE MEMBERSHIP TO ENJOY.
3.STRUCTURE: THIS SHIP IS A SOCIAL CLUB, NOT A MILITARY OR PARAMILITARY ORGANIZATION. OUR EXECUTIVE BOARD, KNOWN AS THE SENIOR OFFICERS, IS RESPONSIBLE PRIMARILY TO THE CREW MEMBERS BELOW, BUT TO THE OFFICERS ABOVE THEM AS WELL.
ARTICLE II GOVERNING REGULATIONS
1.CONSTITUTION: THE CONSTITUTION IS THE BACKBONE OF THIS STARSHIP CHAPTER AND MAY ONLY BE ALTERED BY A TWO-THIRDS VOTE OF THE ENTIRE MEMBERSHIP.
2. GENERAL ORDERS: THE GENERAL ORDERS DEFINE IN MORE DETAIL HOW THE CONSTITUTION IS IMPLEMENTED IN THE ONGOING OPERATION OF THE SHIP. THE GENERAL ORDERS MAY BE ALTERED BY A TWO-THIRDS VOTE OF THE SENIOR STAFF.
ARTICLE III MEMBERSHIP
1.ELIGIBILITY: MEMBERSHIP IS OPEN TO ANY PERSON INTERESTED IN THE PURPOSE AND OBJECTIVES OF THIS SHIP WITHOUT REGARD TO RACE, CREED, COLOR, SEX, AGE, MENTAL OR PHYSICAL IMPAIRMENT, PERSONAL LIFESTYLE, OR PLANETARY ORIGIN. STATUS OF MEMBERSHIP IS CONTINGENT ON DUES BEING CURRENT AND ADHERENCE TO THE RULES AND PROVISIONS SET FORTH IN THIS CONSTITUTION AND GENERAL ORDERS. THE CRITERIA SET FORTH IN THIS CONSTITUTION REPRESENTS THE SOLE MEANS OF ACCEPTING OR DENYING MEMBERSHIP TO THIS ORGANIZATION.
ALL MEMBERS OF THE JOAN OF ARC ARE REQUIRED TO JOIN STARFLEET, WITH THE EXCEPTION OF CADETS AND HONORARY MEMBERS SUCH AS THE SHIP'S AMBASSADOR. PROSPECTIVE MEMBERS (RECRUITS) HAVE SIXTY DAYS FROM THE DATE OF THEIR RECRUITMENT TO JOIN STARFLEET. EXTENSIONS OF THIS TIME PERIOD MAY BE GRANTED ON A CASE BY-CASE-BASIS BY THE COMMANDING OFFICER.
2.TYPES OF MEMBERSHIPS: THERE ARE THREE TYPES OF MEMBERSHIPS: ACTIVE, RESERVE, HONORARY AND CADET.
A.ACTIVE MEMBERS: THOSE WHO HAVE PAID LOCAL DUES TO THE JOAN OF ARC IN ADDITION TO THEIR REQUIRED STARFLEET MEMBERSHIP. THEY HAVE THE RIGHT TO SEEK OFFICE WITHIN THE SHIP, PARTICIPATE IN THE ONLINE DISCUSSION/INFORMATION GROUP, RECEIVE THE CHAPTER NEWSLETTER AND MAY PARTICIPATE IN SHIP'S BUSINESS ACCORDING TO THE LEVEL OF THEIR RANK, POSITION AND SENIORITY.
B.RESERVE MEMBERS: THOSE MEMBERS WHO HAVE JOINED STARFLEET, BUT, FOR WHATEVER REASON, HAVE NOT PAID DUES AT THE LOCAL LEVEL. RESERVE MEMBERS ARE ALLOWED AND ENTITLED TO PARTICIPATE IN ALL SHIP'S ACTIVITIES. HOWEVER, THEY MAY NOT SEEK OFFICE WITHIN THE CHAPTER, MAY NOT PARTICIPATE IN THE ONLINE GROUP, DO NOT RECEIVE THE CHAPTER NEWSLETTER OR PRINTED COPIES OF ANY AWARDS OR PROMOTIONS THEY MAY RECEIVE. SHOULD THEY WISH TO RECEIVE THE NEWSLETTER, A SUBSCRIPTION MAY BE PURCHASED SEPARATELY AT A YEARLY RATE SET BY THE CHIEF OF SECURITY.
C.HONORARY MEMBERSHIP: MAY BE GRANTED SPARINGLY AT THE PREROGATIVE OF THE COMMANDING OFFICER, ON THE RECOMMENDATION OF ANY CREWMEMBER, TO ANYONE DEEMED FIT. SUCH A MEMBERSHIP CARRIES NO VOTING PRIVILEGES OR RIGHT TO SEEK OFFICE, BUT DOES INCLUDE A SUBSCRIPTION TO THE CHAPTER NEWSLETTER AND ACCESS TO THE ONLINE DISCUSSION/INFORMATION GROUP FOR THE DURATION OF THE MEMBERSHIP. SUCH MEMBERS SHALL BE LISTED AS "PASSENGERS" ON THE SHIP'S CREW ROSTER. A HONORARY MEMBERSHIP IS USUALLY AWARDED FOR A PERIOD OF ONE YEAR, BUT THIS CAN BE EXTENDED UPON APPROVAL BY A SIMPLE MAJORITY VOTE OF THE SENIOR OFFICERS.
3.LOCAL DUES:LOCAL MEMBERSHIP FEES CONSIST OF AN ANNUAL FEE COLLECTED AT THE BEGINNING OF EACH CALENDAR YEAR. MEMBERS WHO JOIN THE SHIP DURING THE COURSE OF THE YEAR AND WISH TO BECOME FULL MEMBERS WILL HAVE THEIR LOCAL DUES PRO-RATED ON A QUARTERLY SCALE ACCORDING TO THE QUARTER OF THE YEAR IN WHICH THEY JOIN. LOCAL DUES DO NOT INCLUDE ANNUAL MEMBERSHIP TO STARFLEET. HONORARY MEMBERS ARE NOT CHARGED LOCAL DUES.
4.DELINQUENCY: ANY MEMBER WHO HAS NOT PAID LOCAL DUES BY THE END OF FEBRUARY SHALL BE LISTED AS A "RESERVE" MEMBER AND WILL BE RELIEVED OF ANY CURRENT CHAPTER OFFICES THAT THEY MIGHT CURRENTLY HOLD. EXTENSIONS TO THIS DEADLINE WILL BE CONSIDERED ON A CASE-BY-CASE BASIS BY THE C.O. AND ONLY WHEN ACCOMPANIED BY A GOOD REASON FOR GRANTING SAID EXTENSION.
1.GENERAL MEETINGS: GENERAL MEETINGS SHALL BE HELD A MINIMUM OF ONCE PER MONTH. GENERAL BUSINESS OF THE SHIP IS CONDUCTED AT THESE MEETINGS AND MAY FOLLOW A FORMAL WRITTEN AGENDA. ALL MEMBERS ARE ENCOURAGED TO PARTICIPATE AND HAVE THE RIGHT TO PRESENT POINTS OF BUSINESS FOR DISCUSSION. TIME SHALL ALSO BE ALLOTTED FOR GROUP DISCUSSIONS, SOCIALIZING AND ACTIVITIES NOT CONCERNING BUSINESS DURING SOME PORTION OF THE MEETING.
2.SENIOR OFFICER MEETINGS: SENIOR OFFICER MEETINGS ARE HELD AS NEEDED AND CAN BE CALLED FOR BY ANY SENIOR OFFICER ON APPROVAL FROM THE C.O.. THESE ARE CONVENED TO DISCUSS THE MORE TEDIOUS ITEMS OF SHIP'S BUSINESS, DEAL WITH URGENT OR SPECIAL CONCERNS AND CONCENTRATE SOLELY ON THE BUSINESS OF THE SHIP. ACTIVE GENERAL MEMBERS MAY OBSERVE THESE MEETINGS, BUT WILL HAVE VERY LIMITED INPUT AND MAY BE REQUIRED TO LEAVE FOR THE PURPOSE OF DEALING WITH CONFIDENTIAL MATTERS.
NOTE: TO PRESENT BUSINESS BEFORE A SENIOR OFFICER MEETING, A CREWMEMBER MUST NOTIFY HIS DEPARTMENT HEAD, OR ANOTHER SENIOR OFFICER, AT LEAST 24 HOURS IN ADVANCE.
ARTICLE V THE CAPTAINCY
1.OFFICE: THE COMMANDING OFFICER IS THE PRESIDENT OF THE SHIP AND SHALL BE REGARDED WITH THE PRESTIGE AND DIGNITY DUE HIS POSITION. HE HOLDS THE ULTIMATE RESPONSIBILITY FOR THE EFFICIENT RUNNING OF THE SHIP AND THEREFORE HOLDS AUTHORITY OVER ALL OF ITS DECISIONS AND ACTIVITIES UNDER THE ADVISEMENT OF THE SENIOR OFFICERS. HOWEVER, THIS CHAPTER IS STILL ESSENTIALLY A DEMOCRACY AND THE COMMANDING OFFICER IS THE REPRESENTATIVE OF THE MEMBERSHIP AND ULTIMATELY SERVES AT THEIR PLEASURE.
2.QUALIFICATIONS: IN ORDER TO QUALIFY FOR ELECTION, ANY CANDIDATE FOR THE POSITION OF COMMANDING OFFICER MUST MEET THE FOLLOWING CRITERIA:
A.BE AT LEAST 18 YEARS OF AGE AT THE TIME OF THE ELECTION.
B.BE A FULL MEMBER IN GOOD STANDING OF THE U.S.S. JOAN OF ARC, NCC-73289, AT THE TIME OF THE ELECTION.
C.BE A MEMBER IN GOOD STANDING OF STARFLEET AT THE TIME OF THE ELECTION.
D.MEET ALL CURRENT STARFLEET REQUIREMENTS FOR HOLDING THE POSITION OF
COMMANDING OFFICER.
E.ANY OTHER REQUIREMENTS AS SET FORTH IN THE GENERAL ORDERS.
3.AUTHORITY: THE COMMANDING OFFICER MAY DELEGATE RESPONSIBILITIES FOR VARIOUS ASPECTS OF THE SHIP'S ACTIVITIES TO ANY AND ALL OFFICERS, INCLUDING, BUT NOT LIMITED TO, THOSE SELECTED FOR SENIOR OFFICER POSITIONS. HE MAY, AT ANY TIME AND FOR ANY CAUSE, REWARD ANY MEMBER. HE MAY ALSO AT ANY TIME REMOVE ANY MEMBER FROM A POSITION OF AUTHORITY FOR CAUSE. THIS MAY BE OVERRIDDEN BY A MAJORITY VOTE OF THE SENIOR STAFF.
IF, FOR ANY REASON, A SENIOR OFFICER POSITION BECOMES VACANT, THE CAPTAIN MAY APPOINT A NEW, QUALIFIED SENIOR OFFICER, TO BE RATIFIED BY THE SENIOR OFFICERS.
IT IS STRONGLY ADVISED THAT THE CAPTAIN SEEK COUNSEL IN ALL MATTERS FROM HIS SENIOR OFFICERS, TO PRESERVE THE RIGHT'S AND WISHES OF THE MEMBERSHIP.
4.RESPONSIBILITIES: THE COMMANDING OFFICER IS RESPONSIBLE FOR PROVIDING STARFLEET WITH MONTHLY REPORTS ON THE SHIP'S ACTIVITIES IN A TIMELY AND RESPONSIBLE MANNER. ALL IDEAS AND REQUESTS CONCERNING SHIP'S ACTIVITIES SHOULD BE SUBMITTED THROUGH THE CHAIN OF COMMAND, WITH EACH STEP OF THAT CHAIN PARTICIPATING IN THE DECISION MAKING PROCESS. HOWEVER, ANY OFFICER OR CREWMEMBER HAS THE RIGHT TO APPROACH THE C.O. DIRECTLY IF THE SITUATION WARRANTS IT. THE COMMANDING OFFICER IS ALSO LEGALLY RESPONSIBLE FOR ALL ASSETS, DEBTS AND PROPERTY OF THE CHAPTER AND FOR THE SIGNING OF ANY CONTRACTS THAT IT IS NECESSARY FOR THE SHIP TO ENTER INTO.
5.VOTE OF CONFIDENCE: SHOULD A SITUATION ARISE WHERE THE ACTIONS OF THE COMMANDING OFFICER ARE DEEMED TO BE HAVING SERIOUS DETRIMENTAL EFFECTS ON THE OPERATION OF THIS CHAPTER, A REQUEST FOR A VOTE OF CONFIDENCE CAN BE SUBMITTED TO ANY SENIOR OFFICER ACCORDING TO THE PROCEDURES SET FORTH IN THE GENERAL ORDERS. IF THE VOTE DOES NOT SUPPORT THE C.O., THE SHIP SHALL IMMEDIATELY HOLD ELECTIONS FOR A NEW ONE. IF A C.O. DOES NOT RELINQUISH CONTROL OF THE CHAPTER AS THE RESULT OF AN UNFAVORABLE VOTE OF CONFIDENCE, A LETTER, SIGNED BY THE MAJORITY OF STARFLEET MEMBERS (ACTIVE AND RESERVE BUT NOT HONORARY) SHOULD BE SENT TO THE REGION THREE COORDINATOR FOR APPROPRIATE ACTION. A VOTE OF CONFIDENCE OF THIS TYPE MAY ONLY BE REQUESTED ONCE EVERY FOUR MONTH PERIOD AND SHOULD ONLY WITH THE MOST SERIOUS CAUSE.
ARTICLE VI OFFICERS
1.DEFINITION: AN OFFICER IS ANY CREWMEMBER WHO HAS PASSED THE STARFLEET ACADEMY OTS (OFFICERS TRAINING SCHOOL) COURSE AND HOLDS THE RANK OF ACTING ENSIGN ((A) ENS.) OR ABOVE.
2.COMMAND OFFICERS: THE SENIOR OFFICER OF THIS SHIP SHALL BE THE COMMANDING OFFICER. HE IS IN COMMAND AND ULTIMATELY RESPONSIBLE FOR THE ACTIONS OF THIS SHIP AND HER CREW. THE SECOND MOST SENIOR OFFICER IS THE FIRST OFFICER (EXECUTIVE OFFICER), WHO ASSUMES THE RESPONSIBILITIES OF COMMAND IN THE ABSENCE OF THE COMMANDING OFFICER.
3.SENIOR OFFICERS: THE OFFICE OF FIRST OFFICER IS APPOINTED BY THE C.O.. OTHER SENIOR OFFICERS ARE APPOINTED BY THE C.O., ARE RATIFIED BY THE SENIOR STAFF AND SERVE ON THE SENIOR STAFF AS REPRESENTATIVES OF THEIR DEPARTMENTS. THE SENIOR STAFF IS TASKED WITH THE DUTY OF ADVISING THE COMMANDING OFFICER IN MATTERS CONCERNING THE DAY-TO-DAY RUNNING OF THE SHIP, ASSISTING IN PLANNING ACTIVITIES AND EVENTS, AND PLANNING AND IMPLEMENTING POLICY AS DIRECTED AND APPROVED BY THE COMMANDING OFFICER. THE SENIOR OFFICERS ARE RESPONSIBLE FOR OVERSEEING THEIR RESPECTIVE DEPARTMENTS, OVERSEEING ITS ACTIVITIES AND PERSONNEL AND FAITHFULLY EXECUTING ALL DUTIES ASSOCIATED WITH THEIR DEPARTMENT AS REQUIRED BY THE COMMANDING OFFICER FOR THE EFFICIENT RUNNING OF THE SHIP.
ARTICLE VII PROMOTIONS
1.RECOMMENDATION FOR PROMOTION: IT IS THE DUTY OF A MEMBER'S SUPERIOR OFFICER TO TRACK PROMOTION POINTS AND OTHER INFORMATION RELEVANT TO THEIR PERFORMANCE AND TO RECOMMEND DESERVING CANDIDATES FOR ADVANCEMENT TO THE EXECUTIVE OFFICER. ALL PROMOTIONS BECOME EFFECTIVE UPON APPROVAL OF THE COMMANDING OFFICER.
2.OFFICER RANKS: PROMOTION TO THE RANK OF ENSIGN SHALL RESULT FROM PASSING OF THE STARFLEET OTS COURSE. PROMOTION FROM ENSIGN UP THROUGH THE RANK OF LIEUTENANT COMMANDER (1ST GRADE) SHALL BE BASED ON QUARTERLY REVIEW OF THE OFFICER'S PROMOTION POINTS AND PERFORMANCE. PROMOTION TO THE GRADE OF COMMANDER REQUIRES THE SUCCESSFUL COMPLETION OF OFFICERS COMMAND COLLEGE (OCC). PROMOTIONS TO THE RANK OF CAPTAIN AND SUBSEQUENT FLAG RANKS REQUIRE ADDITIONAL APPROVAL BY REGION THREE AND STARFLEET HEADQUARTERS.
3.CRITERIA: A MEMBER MUST ACHIEVE THE REQUIRED AMOUNT OF PROMOTION POINTS TO ADVANCE IN RANK AND MUST HAVE SERVED IN THEIR CURRENT RANK FOR A MINIMUM OF ONE CALENDAR QUARTER.
OTHER CONSIDERATIONS INCLUDE, BUT ARE NOT LIMITED TO:
A.GRADE AND TIME IN GRADE
B.ATTENDANCE AND PARTICIPATION IN CREW MEETINGS
C.ATTITUDE TOWARDS AND PERFORMANCE OF DUTIES
D.ATTENDANCE AND PARTICIPATION IN SHIP FUNCTIONS
E.ATTENDANCE AND PERFORMANCE IN STARFLEET ACADEMY
F.OTHER CONSIDERATIONS AS LISTED IN THE RANK ADVANCEMENT CHART
IF PROMOTIONS ARE TOO EASY TO ACHIEVE, THEY WILL BECOME MEANINGLESS. IF THEY ARE TOO DIFFICULT, PEOPLE WILL LOSE INTEREST AND DROP OUT. IT IS THE DUTY OF THE SENIOR OFFICERS TO SET AND MAINTAIN A GOOD BALANCE BETWEEN THESE TWO EXTREMES.
4.PROCEDURE: UPON RECOMMENDATION FROM THE MEMBER'S DEPARTMENT HEAD, THE EXECUTIVE OFFICER REVIEWS THE CANDIDATE'S QUALIFICATIONS AND FITNESS FOR PROMOTION. A RECOMMENDATION IS THEN MADE TO THE COMMANDING OFFICER FOR HIS CONSIDERATION. THE EXECUTIVE OFFICER MAY RECOMMEND ANY OF THE FOLLOWING:
A. PROMOTION RECOMMENDED
B. PROMOTION NOT RECOMMENDED
THE COMMANDING OFFICER WILL THEN EITHER APPROVE OR REJECT THE CANDIDATE'S PROMOTION. PROMOTIONS SHALL BE AWARDED AT THE FIRST MEETING OR EVENT OF THE QUARTER. PROMINENT REGIONAL OR FLEET EVENTS ARE ALSO ACCEPTABLE VENUES.
5.FREQUENCY: THIS PROCESS SHALL OCCUR EVERY CALENDAR QUARTER.
ARTICLE VIII DISCIPLINARY ACTION
1.INFRACTION: AN INFRACTION IS AN ACTION TAKEN BY A MEMBER OF THIS CHAPTER WHICH DIRECTLY OR INDIRECTLY VIOLATES THE CONSTITUTION AND/OR THE GENERAL ORDERS OF THIS VESSEL.
2.PROCEDURE: THIS SHIP IS NOT A MILITARY ORGANIZATION. THE RIGHTS OF ITS MEMBERS ARE FULLY PROTECTED BY THE LAWS OF THE UNITED STATES OF AMERICA. DISCIPLINARY ACTION SHALL CONSIST OF THE FOLLOWING MEASURES AND SHALL BE CONSIDERED PUNISHMENT IN FULL EXCEPT IN ANY CASES WHEREAS THE INFRACTION VIOLATES THE LAW AT ANY LEVEL. ANY CASE INVOLVING CRIMINAL ACTIVITY REQUIRES THAT THE PROPER AUTHORITIES BE CONTACTED AND THE FULL COOPERATION OF THIS CHAPTER AND HER CREW SHALL BE GIVEN TO THEM.
ALL MEMBERS ARE PRESUMED TO BE WORKING FOR THE COMMON GOOD OF THE SHIP'S COMPANY, AND INFRACTIONS SHALL INITIALLY BE VIEWED AS OVER ZEALOUS ATTEMPTS TO FURTHER THAT END. COUNSELING SHALL CONCENTRATE ON POSITIVE BEHAVIORS AND SHOULD SERVE AS AN EDUCATIONAL PROCESS REGARDING THE SHIP'S RULES AND STANDING ORDERS. DEMEANING FORMS OF PUNISHMENT SHALL NOT BE TOLERATED AND WILL LEAD TO DISCIPLINARY ACTION AGAINST ANY WHO ENGAGE IN IT.
A.FIRST INFRACTION: A VERBAL WARNING MAY BE GIVEN BY A SENIOR OFFICER, NOT NECESSARILY THE C.O., X.O. OR PERSON'S DEPARTMENT HEAD. THE WARNING SHALL BE GIVEN IN PRIVATE WITH NO PUBLIC DISCUSSION BEING MADE AND ONLY A BRIEF NOTE IN THE PERSONS FILE STATING WHAT ISSUE WAS ADDRESSED, ON WHAT DATE AND BY WHOM.
B.SECOND INFRACTION: THE WARNING IS WRITTEN UP FORMALLY, AND THE MEMBER IS COUNSELED IN PRIVATE (THIS TIME BY THEIR DEPARTMENT HEAD) AS TO THE POTENTIAL DISCIPLINARY ACTION FOLLOWING FURTHER BREACHES. THE WRITTEN WARNING IS THEN PUT INTO THE CREWMEMBER'S PERSONNEL FILE.
C.THIRD INFRACTION: THE WARNING IS WRITTEN, AS BEFORE, AND THE MEMBER IS COUNSELED IN CLOSED SESSION BY THE EXECUTIVE OFFICER IN THE PRESENCE OF THE MEMBER'S DEPARTMENT HEAD.
D.FOURTH INFRACTION: THE MEMBER WILL RECEIVE A WRITTEN WARNING, COUNSELING BY THE COMMANDING OFFICER, AND MAY HAVE HIS LOCAL MEMBERSHIP SUSPENDED FOR A PERIOD NOT TO EXCEED 3 MONTHS (90 DAYS).
E.FIFTH INFRACTION: THE MEMBER RECEIVES A WRITTEN STATEMENT SUMMARIZING THE EVENTS TO DATE, AND COUNSELING BY THE COMMANDING OFFICER, WHO MAY ELECT TO SUSPEND THE PERSON'S LOCAL MEMBERSHIP FOR UP TO 1 YEAR. HE ALSO HAS THE OPTION TO TERMINATE THE OFFENDER'S MEMBERSHIP WITH THE U.S.S. JOAN OF ARC PERMANENTLY, WITH AN ACCOMPANYING MAJORITY VOTE BY THE SENIOR OFFICERS. IF MEMBERSHIP IS REVOKED, THE PERSON SHALL RECOVER ANY PAID LOCAL DUES PRORATED ON A QUARTERLY SCALE.
3. RECORD KEEPING: A COPY OF ALL WRITTEN WARNINGS WILL BECOME PART OF THE MEMBER'S PERSONNEL FILE. AFTER A PERIOD OF AT LEAST SIX MONTHS, WITH NO FURTHER INFRACTIONS OF THE SAME TYPE, THE MEMBER MAY PETITION THE COMMANDING OFFICER TO PURGE THE REPRIMAND FROM HIS FILE. IF THE C.O. CONCURS, ANY AND ALL DOCUMENTS CONCERNING THE INFRACTION SHALL BE REMOVED AND DESTROYED. THERE WILL BE NO FURTHER MENTION MADE OF THE INCIDENT AND IT WILL BE TREATED AS NEVER HAVING OCCURRED.
4.SERIOUS OFFENSES: THE FOLLOWING INFRACTIONS MAY WARRANT A WRITTEN WARNING AND TREATMENT AS AN AUTOMATIC "FOURTH INFRACTION."
A.FAILING TO ADHERE TO THE SHIP'S CHAIN OF COMMAND OR PREEMPTING THE DECISIONS OF THE CAPTAIN IN THE CONDUCT OF THE SHIP'S BUSINESS.
B.INCITING ILL-WILL TOWARD THE CAPTAIN AND/OR A SENIOR OFFICER IN SUCH A MANNER AS TO CAUSE THE SHIP'S COMPANY TO BECOME ANGERED OR DIVIDED AGAINST ITSELF.
C.PETTY THEFT (LESS THAN $25 VALUE) OF FUNDS OR MATERIALS.
5.TERMINATION OFFENSES: THE FOLLOWING ACTIONS MAY CAUSE THE MEMBER TO BE IMMEDIATELY DISCHARGED FROM THE SHIP'S COMPANY WITHOUT BENEFIT OF THE ABOVE STEPS, AND WITH NO FURTHER WARNING BEING ISSUED:
A.ANY ACTION BY A MEMBER WHICH INVOLVES SEXUAL HARASSMENT, ANY THEFT VALUED AT OVER $25, FALSE ACCUSATION, MALICIOUS LYING AND/OR SLANDER ABOUT ANOTHER MEMBER, OR ANY VIOLENT ACT AGAINST ANOTHER MEMBER (WITH OR WITHOUT WEAPONS INVOLVED).
B.ANY ACT WHICH, IN THE OPINION OF THE SENIOR OFFICERS, CONSTRUES INSUBORDINATE BEHAVIOR TO THE COMMANDING OFFICER, MUTINY OR SEDITION, OR A FIFTH INFRACTION INVOLVING ACTS WHICH MAY BE CONTRARY TO THE CONDUCT OF GOOD ORDER AND DISCIPLINE OF THE SHIP.
C.ANY ACT WHICH, IN THE OPINION OF THE COMMANDING, EXECUTIVE AND/OR SENIOR OFFICERS, BRINGS PUBLIC DISGRACE ON THE SHIP'S COMPANY.
6.TERMINATION: SHOULD "TERMINATION OF MEMBERSHIP" RESULT FROM THESE PROCEEDINGS, THE OFFENDING EX-MEMBER FORFEITS ANY FUTURE ASSOCIATION WITH THE U.S.S. JOAN OF ARC, AND MAY NOT RE-APPLY TO THIS CHAPTER FOR MEMBERSHIP. THIS DOES NOT IN ANY WAY PREVENT THE EX-MEMBER FROM SEEKING MEMBERSHIP IN ANOTHER STARFLEET CHAPTER, ALTHOUGH RECORDS IN HIS FILE MAY BE PASSED ALONG TO ANOTHER COMMANDING OFFICER PERFORMING A BACKGROUND CHECK
6.RIGHTS OF THE MEMBER: NONE OF THE ABOVE WILL IN ANY WAY FOREGO THE INDIVIDUAL'S RIGHTS UNDER THE LAWS OF THE UNITED STATES. A MEMBER HAS THE RIGHT TO APPEAL ANY DECISION MADE BY THE CAPTAIN. THE MEMBER MAY APPEAL TO THE PROPER REGIONAL AUTHORITY; OR, FAILING THAT, TO STARFLEET COMMAND AND THE COMMANDER, STARFLEET, WHOSE DECISION ON THE MATTER SHALL BE FINAL.
ARTICLE IX LIABILITY OF MEMBERS
1.FISCAL LIABILITY: NO OFFICER, MEMBER OR AFFILIATED PERSON, OTHER THAN THE COMMANDING OFFICER, SHALL BE PERSONALLY LIABLE FOR ANY DEBTS OR OBLIGATIONS OF THIS SHIP, PAST OR PRESENT, EXCEPT FOR THE PAYMENT OF PERSONAL MEMBERSHIP DUES. LIKEWISE, NO OFFICER OR MEMBER OF THE SHIP SHALL DISPENSE MONIES, SIGN CONTRACTS, FISCALLY BIND THE SHIP OR HER CREW, OR OTHERWISE OBLIGATE THIS SHIP, HER OFFICERS, AND/OR HER CREW WITHOUT THE EXPRESS WRITTEN CONSENT OF THE COMMANDING OFFICER.
2.SHIP'S RECORDS: NO NON-MEMBER SHALL BE ALLOWED TO OBTAIN, FOR ANY REASON, PERSONAL INFORMATION (IE: ADDRESS, PHONE NUMBER, EMAIL ADDRESS, ETC.) OF THIS CHAPTER'S MEMBERSHIP UNLESS PRIOR WRITTEN PERMISSION HAS BEEN GIVEN TO RELEASE IT. NOR MAY ANY NON-MEMBER USE THIS SHIP'S NAME, INFORMATION OR LOGO FOR ANY REASON WITHOUT THE EXPRESS WRITTEN CONSENT OF THE SENIOR STAFF AND FINAL APPROVAL BY THE COMMANDING OFFICER. INFORMATION SUCH AS NAMES, PERSONA NAMES, RANKS, POSITION AND SIMILAR "SURFACE LEVEL" INFORMATION SHALL BE CONSIDERED PUBLIC KNOWLEDGE UNLESS SPECIFICALLY REQUESTED BY THAT PERSON THAT IT BE WITHHELD.
3.DISSOLUTION: IN THE EVENT THAT THIS CHAPTER DECIDES TO DISBAND, ALL MAILING LISTS OF IT'S MEMBERSHIP SHALL BE DESTROYED AND ALL PROPERTY OF THE SHIP SHALL BE SOLD AT AUCTION WITH THE PROCEEDS GOING INTO THE SHIP'S TREASURY. AFTER ALL THE CHAPTER'S DEBTS HAVE BEEN PAID, ANY REMAINING FUNDS FROM THE SHIP'S TREASURY, INCLUDING FUNDS RAISED AT AUCTION, SHALL BE DONATED TO A LOCAL CHARITY TO BE DETERMINED BY THE SENIOR OFFICERS.
ARTICLE X SHIPS ARCHIVES
THIS ARTICLE HAS BEEN REMOVED AS ARCHIVIST POSITION WITHIN THE CHAPTER HAS BEEN DISSOLVED.
ARTICLE XI AMENDMENT PROCEDURE
1.THIS CONSTITUTION MAY BE AMENDED BY A TWO-THIRDS MAJORITY OF ACTIVE MEMBERS NOT ABSTAINING, AS DESCRIBED IN THE GENERAL ORDERS, WITH ONE MONTH'S NOTICE.
ARTICLE XII DOCUMENTATION
1.THIS DOCUMENT SHALL MAINTAIN THE DATE OF ACCEPTANCE OF THIS DOCUMENT AND EACH OF ITS MODIFICATIONS.
